How Kentucky Law Governs Revocable Living Trusts

Kentucky adopted the Uniform Trust Code, codified at KRS Chapter 386B and effective July 15, 2014, which sets the rules for how trusts are created, amended, and administered in the state. Under that framework, the mental capacity required to create, amend, or revoke a revocable trust is the same capacity required to make a will, and as long as you have that capacity, you can modify or cancel the trust at any time during your lifetime.

One point worth clarifying: Kentucky does not impose a state estate tax. It does impose an inheritance tax, but transfers to a spouse, children, grandchildren, parents, or siblings are fully exempt, regardless of whether assets pass through a trust or a will. A revocable living trust doesn’t change that calculation on its own.

Probate Avoidance in Daviess County

A trust can help avoid probate only for assets that have actually been retitled into the trust’s name. That process, called funding the trust, is a critical step that’s easy to overlook.
